CONSUMER RIGHTS – CONDITIONS OF WITHDRAWAL, CANCELLATION AND REFUND
- In the event you place an order electronically through the website you are using, you will be deemed to have accepted the preliminary information form and the distance sales agreement presented to you.
2.Buyers are subject to the provisions of the Consumer Protection Law no. 6502 and the Distance Agreements Regulation (RG:27.11.2014/29188), as well as the other applicable laws regarding the sales and delivery of the products they purchase.
3.Courier charges, which are the shipping costs of the products, will be paid by Buyers.
4.Each product purchased is delivered to the person and/or organization at the address indicated by the buyer within the legal period of 30 days. If the product is not delivered within said period, Buyers may terminate the Agreement.
5.The product purchased must be delivered in full, complying with the qualifications specified in the order, and accompanied by any documents such as the warranty certificate or the user manual, if any.
6.In the event it becomes impossible to sell the purchased product, the Seller must notify the Buyer in writing within 3 days of learning about this situation. The total prices must be returned to the Buyer within 14 days.
IF THE PRICE OF THE PRODUCT PURCHASED IS NOT PAID:
7.If the Buyer does not pay the price of the purchased product or the cancels the payment in bank records, the Seller will be released from his obligation to deliver the product.
PURCHASES TRANSACTED WITH UNAUTHORIZED USE OF CREDIT CARD:
8.In the event it is determined, after delivery of the product, that the credit card used by the buyer for payment has been wrongfully used by unauthorized persons and if the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product under the Agreement to the Seller within 3 days, the shipping costs of which will be borne by the Seller.
IF THE PRODUCT IS NOT DELIVERED ON TIME FOR UNFORESEEN REASONS:
9.In the event of force majeure events that are unforeseeable by the Seller and failure to deliver the product on time, this situation will be notified to the Buyer. The Buyer may request for cancellation of the order, replacement of the product with a similar one or postponement of the delivery until the force majeure event disappears. In case the Buyer cancels the order, the payment will be returned in cash to the Buyer within 14 days from the date of cancellation if the payment was made in cash. If the Buyer cancels the order, which was paid with a credit card, the price of the product is returned to the bank within 14 days from the date of cancellation; however, it may take 2-3 weeks for the bank to return the amount to the Buyer’s account.
OBLIGATION OF THE BUYER TO CHECK THE PRODUCT:
10.The Buyer shall check the product/service subject to the Agreement before receiving it and shall not accept the delivery of bruised, broken, damaged and defective product/service from the courier company. It will be considered that the product/service, the delivery of which is accepted by the Buyer, is free of damage and defect. The Buyer is obligated to protect the product/service with care after delivery. If the right of withdrawal will be exercised, the product/service must be unused. The Invoice must be returned along with the product.
RIGHT OF WITHDRAWAL:
11.Within 14 (fourteen) days from the date of delivery of the product purchased to the person/organization at the address indicated by the Buyer, the Buyer may exercise his right of withdrawal from the Agreement by refusing the product without assuming any legal and penal liability and without giving any reason provided that the Seller is notified via the following contact information:

13.If it is a service that is purchased by the Buyer, this 14-day period starts when the service is purchased. Before the expiry of the right of withdrawal, the right of withdrawal may not be exercised in service agreements that start upon the approval of the consumer.
14.Expenses arising from exercising the right of withdrawal are borne by the Seller.
15.In order to exercise the right of withdrawal, a written notice must be given to the Seller via registered mail, fax or e-mail within 14 (fourteen) days and the product must be unused in accordance with the provisions of the “Products for which the Right of Withdrawal Cannot be Exercised” set out in this Agreement.
EXERCISING THE RIGHT OF WITHDRAWAL:
16.The invoice of the product delivered to a 3rd party or the Buyer (and, if the invoice of the product to be returned is issued to an organization, the return invoice issued by the organization) must be sent with the product. The returns of the orders, the invoices of which are issued to organizations, may not be completed unless a RETURN INVOICE is issued.
17.The product to be returned must be delivered with its box, packaging and standard accessories, if any, in full and in an undamaged state along with the return form.
CONDITIONS OF REFUND:
18.The Seller is obliged to return to the Buyer the total price along with the documents obligating the Buyer within 10 days of receiving the notice of withdrawal and receive the product returned within 20 days.
19.In the event there is a decrease in the value of the product or returning the product becomes impossible due to a reason attributable to the fault of the Buyer, the Buyer is liable to compensate the damages of the Seller in proportion to his fault. However, the Buyer is not responsible for any changes and damages resulting from proper use of the product or the goods during the period of right of withdrawal.
20.In the event the Buyer’s purchase falls under the campaign limit amount set by the Seller when the right of withdrawal is exercised, the amount of discount used under the campaign will be cancelled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:
21.In accordance with the Regulation, it is not possible to return products that are prepared in line with the Buyer’s request or explicit personal needs, which are not suitable for return, underwear, swimsuit and bikini bottoms, makeup materials, disposable products, perishable products or products that are likely to expire, products that are not suitable for return in terms of health and hygiene when their packaging is opened by the Buyer after delivery to the Buyer, products that are mixed with other products after delivery and cannot be separated by nature, products related to periodicals such as newspapers and magazines, except for those provided under a subscription agreement, services rendered instantly in electronic environment or intangible goods instantly delivered to the consumer, as well as any sound and voice recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, the packaging of which are opened by the Buyer. Furthermore, it is not possible in accordance with the Regulation to exercise the right of withdrawal for the services that start upon approval of the consumer prior to expiration of the Right of Withdrawal duration.
22.Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, reproducible software and programs, DVDs, VCDs, CDs, cassettes and stationary consumables (toner, cartridge, ribbon, etc.) may be returned provided they are intact in their original packaging, undamaged and unused.
EVENT OF DEFAULT AND LEGAL CONSEQUENCES
23.If the Buyer has made the payment via his credit card and is in default, the Buyer agrees, declares and undertakes that he shall pay interest and be liable towards the bank under the credit card agreement between the card holder and the bank. In this case, the bank concerned may seek legal remedies and claim the expenses and the counsel’s fee that will arise from the Buyer. In any case, in the event the Buyer is in default due to his debt, the Buyer agrees to pay the damages and losses incurred by the Seller due to delayed payment of the debt.
